User Agreement

This User Agreement is a binding agreement between you and TourDrivers, operated by SKAIX For Online Selling (“TourDrivers”, “we”, “us” or “our”). It governs your access to tour-drivers.com and related TourDrivers services. By creating an account, requesting or sending a quote, making a booking, or connecting a payout account, you accept this agreement.
1. Marketplace role
TourDrivers is a marketplace that helps travelers find independent drivers and transport companies, exchange quotes, communicate and arrange bookings. Unless expressly stated otherwise, TourDrivers is not the driver, vehicle operator or transport provider. The provider is responsible for performing the booked service.
2. Eligibility and accounts
You must be legally able to enter a binding agreement and must provide accurate, current and unique account information. You are responsible for safeguarding your credentials and activity under your account. A provider must keep licences, identity details, vehicle records, insurance and any permits required by applicable law accurate and current.
3. Quotes and bookings
A trip request is not a booking. A provider’s quote must accurately describe the vehicle, price, inclusions, exclusions, validity, payment method and applicable terms. A booking becomes confirmed only when TourDrivers records the traveler’s acceptance and any required online payment has succeeded. Prices and currencies shown in the confirmed booking record control.
4. Payments, commissions and fees
A quote may permit online payment through TourDrivers or direct payment to a verified provider. Travelers see the total booking price. Before submitting a quote, providers see the applicable TourDrivers commission and their expected net amount. A payment-gateway fee may be included in an online booking total paid by the traveler.
For a direct-payment booking, the verified driver—not TourDrivers—provides and is responsible for the transport service and receives the traveler’s payment directly. TourDrivers verifies specified profile information and, where legally permitted and reasonably required for a complaint, may provide available driver identification or verification records to the traveler or competent authorities. Travelers remain responsible for assessing whether the service is suitable and for following applicable local laws. To the fullest extent permitted by law, TourDrivers is not liable for a driver’s acts, omissions, service performance, safety, loss, injury or direct-payment disputes. Nothing in this agreement excludes or limits any liability or consumer right that cannot lawfully be excluded.
For direct-payment bookings, the provider remains responsible for the TourDrivers commission shown when the quote is submitted. Unpaid direct commissions may be deducted from eligible wallet credits and may limit the provider to online bookings. For online bookings, provider earnings are credited to the TourDrivers wallet according to the accepted installment schedule after traveler funds clear. Wallet withdrawal availability and any third-party withdrawal fee are shown before withdrawal.
PayPal and Stripe provide payment services under their own terms. Connecting a PayPal account authorizes TourDrivers to use the returned verified-account information and payer ID for payout operations; it does not give TourDrivers the provider’s PayPal password.
5. Cancellations and refunds
The cancellation terms displayed and accepted for a quote form part of the booking. Unless the confirmed booking states otherwise, TourDrivers online-payment terms provide a full traveler refund for cancellation more than 48 hours before pickup; a 50% deduction for cancellation within 48 hours before pickup; and, after a trip starts, completed days payable in full plus a deduction of 50% of the value of remaining trip days. Payment-processor charges and non-refundable costs may affect the amount returned where permitted by law.
TourDrivers may pause a wallet credit or withdrawal while a cancellation, chargeback, safety report, refund or payment dispute is investigated. Nothing in this section limits non-waivable consumer rights.
6. Communication and contact-sharing policy
Before a booking is confirmed, users must keep conversations on TourDrivers. Sharing or requesting phone numbers, WhatsApp details, email addresses, website links, social-media handles, payment handles or other information intended to move a transaction outside TourDrivers is prohibited. TourDrivers may mask such information, prevent a message from being sent, flag content for review, suspend an account or remove a profile from search.
7. Acceptable use
You must not misuse the platform, impersonate another person, publish false information, evade fees, manipulate reviews, send unlawful or abusive content, attempt unauthorized access, introduce malicious code, interfere with security controls or use TourDrivers to facilitate illegal activity. Messages and uploads must relate to legitimate marketplace activity.
8. Provider responsibilities
Providers are independent businesses or contractors, not employees, agents, partners or representatives of TourDrivers, and have no authority to bind TourDrivers. Providers are solely responsible for safely and lawfully performing each transport service; maintaining all licences, permits, registrations and insurance required where they operate; supplying roadworthy and suitable vehicles; accurately stating availability, price, capacity and service details; attending agreed pickups; following the confirmed itinerary and booking terms; collecting direct payments and issuing any legally required receipt; paying applicable taxes; and supervising their personnel, substitutes and subcontractors.
A provider must promptly tell the traveler and TourDrivers about any expected delay, cancellation, vehicle substitution, safety issue or inability to perform. The provider is responsible for claims, losses, injury, property damage, fines, penalties, refunds or other consequences caused by the provider’s service, breach, negligence, unlawful conduct, personnel or vehicle, except to the extent caused by TourDrivers. Verification badges indicate checks completed using information available at the time; they are not an endorsement or guarantee of identity, licensing, insurance, future conduct, safety or service quality.
9. Traveler responsibilities
Travelers are responsible for providing accurate trip, pickup, passenger, child-seat, accessibility and luggage information; reviewing the provider, vehicle, quote and booking terms before acceptance; being ready at the agreed time and place; paying the confirmed price using the stated payment method; complying with applicable laws and reasonable safety instructions; supervising minors and personal property; and ensuring that members of their party behave lawfully and do not damage a provider’s vehicle or property.
For direct-payment bookings, the traveler pays the provider rather than TourDrivers and should retain payment evidence and receipts. The traveler is responsible, to the extent permitted by law, for loss, cleaning costs, property damage, fines or claims caused by the traveler or their party, except to the extent caused by the provider or TourDrivers.
10. Claims and indemnity
To the fullest extent permitted by applicable law, a provider will defend, indemnify and hold TourDrivers and its officers, employees and contractors harmless from third-party claims, regulatory action, fines, losses, damages and reasonable legal costs arising from the provider’s transport services, vehicle, personnel, breach of this agreement, infringement of another person’s rights, negligence or unlawful conduct.
To the fullest extent permitted by applicable law, a traveler will defend, indemnify and hold TourDrivers and its officers, employees and contractors harmless from third-party claims, fines, losses, damages and reasonable legal costs arising from the traveler’s or their party’s breach of this agreement, unlawful conduct, infringement of another person’s rights or damage to a provider’s vehicle or property.
These obligations do not apply to the extent a claim or loss was caused by TourDrivers’ own breach, negligence, fraud or wilful misconduct, and they do not exclude any right or liability that applicable law does not allow the parties to exclude.
11. Your content
You retain ownership of content you submit. You grant TourDrivers a worldwide, non-exclusive licence to host, reproduce, format, translate, moderate and display that content as reasonably required to operate, secure and promote the marketplace. You must have the rights and permissions needed for anything you upload.
12. Suspension and termination
You may stop using TourDrivers at any time. We may restrict, suspend or close an account, with or without advance notice where reasonably necessary, for suspected fraud, safety risks, payment problems, legal requirements, repeated complaints or violation of this agreement. Existing booking, payment, refund, commission and recordkeeping obligations survive account closure.
13. Service availability and limitation of responsibility
We work to keep TourDrivers reliable and secure, but the service may occasionally be unavailable, delayed or contain errors. To the fullest extent permitted by law, the platform is provided on an “as available” basis. TourDrivers does not control and is not responsible for the acts or omissions of independent travelers or providers, transport performance, vehicle condition, personal safety, user-provided information, direct payments, or events outside TourDrivers’ reasonable control.
To the fullest extent permitted by law, TourDrivers will not be liable for indirect, incidental, special, exemplary or consequential loss, or loss of profit, opportunity, data or goodwill, arising from use of the marketplace or a booking. Nothing in this agreement excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any mandatory consumer or other right that cannot lawfully be excluded.
14. Changes, disputes and contact
We may update this agreement for legal, security or service changes. The revised agreement will be published here with a new effective date. Users must cooperate reasonably with safety reports, complaints, chargebacks and lawful investigations, including preserving and providing relevant booking, communication and payment evidence. Applicable mandatory law governs your rights, and the parties should first try to resolve a dispute through TourDrivers support. For questions, email info@tour-drivers.com.
